TERMS AND CONDITIONS
ARTICLE 1 – DEFINITIONS
- The Vintage Atelier: The user of these general terms and conditions and the provider of the products.
- Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with The Vintage Atelier.
- Agreement: The distance contract between The Vintage Atelier and the Consumer for the purchase of vintage goods.
ARTICLE 2 – THE VINTAGE COLLECTION & PRODUCT CONDITION
- Nature of Goods: The Consumer acknowledges that all items offered by The Vintage Atelier are vintage, antique, or second-hand. These items have a history and, as such, typically show signs of previous use, aging, wear, and patina.
- Acceptance of Condition: Products are sold in the condition they are in at the time of purchase ("as is"). Detailed photographs and descriptions are provided for each item. Minor imperfections, color variations (due to digital display), or age-related wear do not constitute a defect but are part of the character of the item.
- Product Eligibility for Shipping: Not all items in the atelier are eligible for shipping due to their size, weight, or extreme fragility. The Consumer is responsible for checking the Product Specifications on the product page. If an item is marked as "Pick-up Only", it cannot be shipped. The Vintage Atelier reserves the right to cancel and refund any order where shipping was selected for a "Pick-up Only" item.
ARTICLE 3 – PRICING & PAYMENT
- Prices: All prices are listed in Euros and include VAT.
- Margin Scheme: The Vintage Atelier operates under the VAT Margin Scheme (Margeregeling) for second-hand goods. Therefore, VAT is not separately specified on the invoice and is not deductible for business entities.
- Payment: The agreement is finalized once the Consumer completes the payment process. All orders must be paid in full before processing.
ARTICLE 4 – SHIPPING & DELIVERY
- Shipping Destinations: The Vintage Atelier provides standard shipping exclusively to the Netherlands and Belgium. We do not ship to Germany or other countries by default.
- Processing Time: We strive to process and hand over orders to our carrier within 3 to 5 business days after payment confirmation.
- Carrier: Standard shipments are handled by PostNL. Delivery times after dispatch are indicative and subject to the carrier's performance.
- Oversized & Fragile Cargo: For items that exceed standard parcel dimensions, specialized transport may be required. Associated costs and risks will be communicated to the Consumer.
- Shipping Address: The Consumer is responsible for providing a correct and complete shipping address. Any costs arising from incorrect address details will be charged to the Consumer.
ARTICLE 5 – RIGHT OF WITHDRAWAL & RETURNS
- Cooling-off Period: The Consumer has the right to dissolve the agreement within 14 days of receiving the product without providing a reason.
- Conditions during Cooling-off: During this period, the Consumer must handle the item and its packaging with the utmost care. The item must remain in the exact same condition as when it left the atelier.
- Return Shipping Costs: The costs for returning the product are entirely at the expense of the Consumer.
- Risk of Return: The risk and burden of proof for the correct and timely return of the product lie with the Consumer. We strongly recommend insured and registered shipping. If an item is lost or damaged during return transit, The Vintage Atelier cannot issue a refund.
- Refunds: Upon receipt and inspection of the returned item, a refund of the purchase price will be issued within 7 business days via the original payment method. Original shipping costs are non-refundable.
ARTICLE 6 – DAMAGE DURING TRANSIT & COMPLAINTS
- Immediate Inspection: The Consumer is obliged to inspect the package upon delivery.
- Reporting Damage: If an item arrives damaged, the Consumer must report this via email within 24 hours of receipt. This report must include clear photographs of:The external packaging (with the shipping label visible).The internal packaging.The damage to the item itself.
- Late Reports: Complaints filed after 24 hours of receipt may be denied as we cannot hold the carrier liable after this window.
ARTICLE 7 – WARRANTY & LIABILITY
- No Manufacturer's Warranty: Due to the vintage and second-hand nature of the products, no manufacturer's warranty applies.
- Exclusion of Liability: The Vintage Atelier is not liable for damages resulting from the use of the products, including but not limited to the failure of vintage electronics, instability of vintage furniture, or any injury resulting from the age or construction of the items.
ARTICLE 8 – UNCLAIMED PACKAGES
- If a package is returned to The Vintage Atelier because it was not collected from a pickup point in time or because the delivery was refused, the Consumer will be refunded the item price minus the original shipping costs and any return fees charged by the carrier.
ARTICLE 9 – FORCE MAJEURE
- The Vintage Atelier is not obliged to fulfill any obligation if prevented from doing so by force majeure (e.g., transport strikes, fire, or supply chain disruptions).
ARTICLE 10 – GOVERNING LAW
- These terms and conditions are exclusively governed by Dutch Law.
- Any disputes shall be submitted to the competent court in the district where The Vintage Atelier is established.
